1. The Service
MakeTribute ("we", "us", "our") provides an AI-powered photo animation service that transforms uploaded personal photos into fully edited cinematic video tributes ("the Service"). By placing an order and completing payment, you agree to these Terms of Service in full.
2. Orders & Delivery
- Videos are typically delivered to your email within 30–60 minutes of order placement.
- Delivery time may vary depending on order volume, photo quantity, and technical conditions.
- During periods of high demand, processing times may be longer than usual. Your order will be queued and processed automatically — no action required. You will receive your video as soon as processing is complete.
- You will receive a download link valid for 7 days. After expiry, the link cannot be recovered.
- If you do not receive your video within 2 hours, please contact us at service@maketribute.com
- Once payment is completed and video production begins, the process is irreversible and cannot be cancelled until the video is completed and delivered.
3. Pricing
MakeTribute uses a per-photo pricing model. Your order total is calculated automatically as:
Total = number of photos uploaded × price per photo
Current rate: $1.75 per photo · Minimum: 20 photos ($35.00) · Maximum: 48 photos ($84.00)
- The price is calculated server-side at the time of order based on the number of photos you upload. The amount displayed at checkout is final and binding.
- You are charged only for the photos you upload — never more. If you upload 27 photos, you pay for 27 photos.
- The minimum order is 20 photos. The maximum is 48 photos.
- We reserve the right to adjust the per-photo price at any time. Price changes do not affect orders already placed and paid.
Coupon & Discount Codes
MakeTribute may issue single-use discount coupon codes for promotional purposes. The following conditions apply:
- One-time use only: Each coupon code is valid for a single order and becomes permanently invalid after redemption.
- Discount types: A coupon may provide a percentage discount (e.g. 50% off) or a full 100% discount (free order). The discount applies to the computed order total at the time of checkout.
- 100% discount orders: A coupon providing a 100% discount skips payment processing entirely. All Terms of Service apply, including photo content rules and non-refund provisions. No payment is collected and therefore no refund can be issued.
- Partial discount orders: A coupon providing a partial discount reduces the PayPal charge accordingly. The reduced amount is the final binding price for that order.
- No cash value: Coupon codes have no cash value and cannot be exchanged, transferred, or applied to previous orders.
4. Payment & Refund Policy
- All prices are displayed in USD. Payment is processed securely via PayPal.
- ALL SALES ARE FINAL. We do not offer refunds once video processing has begun.
- Refunds are issued only in the following cases:
- You did not receive your video email due to a technical failure on our end (confirmed via our delivery logs showing non-delivery)
- A critical technical failure occurred after payment that prevented video creation entirely
- If you believe you are entitled to a refund, contact service@maketribute.com with your order ID. We will verify delivery status via our email delivery logs (Brevo). Note: if our logs confirm the email was delivered to your address, no refund will be issued.
- Refunds, if approved, are issued via PayPal only — no other refund method is available.
The following are not grounds for a refund:
- Dissatisfaction with AI animation style or quality
- Minor visual imperfections in one or more clips
- Video shorter than expected due to low-quality photos
- Unused photos due to quality issues
5. AI Technology & Expected Results
Our service uses the most advanced AI video generation tools currently available. However, AI technology is not perfect, and by placing an order you acknowledge and accept the following possible outcomes:
- Animation quality: AI animation results vary based on photo quality, lighting, resolution, and subject matter. We cannot guarantee specific animation styles or results.
- Unknown people: In group or crowd photos, AI may animate people in the background who are not the intended subject. This is a normal result of AI processing of group imagery.
- Minor imperfections: AI-generated clips may contain minor visual artifacts such as slight distortion of facial features, disappearance or alteration of birthmarks or small marks, subtle changes in hair or clothing details, or occasional unnatural movement. These are inherent limitations of current AI technology and are not grounds for refund.
- Shorter video: Your video may be shorter than the selected package duration if some photos are too blurry, low resolution, contain no visible faces, or fail AI quality checks. In these cases, unusable photos are skipped and the video is delivered with the successfully processed clips.
- Unused photos: We do not guarantee that all uploaded photos will be used. Photos that do not meet minimum quality requirements may be excluded from the final video.
- Irreversibility: Once AI processing begins, each photo-to-clip conversion is permanent. We cannot selectively redo individual clips.
6. User Responsibility & Photo Quality
The quality of the final video depends directly on the quality and suitability of the photos you upload. MakeTribute is not responsible for unsatisfactory results caused by user error or negligence in photo selection.
You are solely responsible for reviewing your photos carefully before submitting payment. No refunds will be issued due to poor results caused by any of the following:
- Back-facing subjects: photos where the person's back is to the camera. When animated, the AI may generate a completely different-looking face.
- Overexposed or underexposed photos: images that are too bright, too dark, or washed out.
- Heavily damaged photos: severely torn, crumpled, stained, or water-damaged images beyond reasonable wear.
- Partial faces: photos where a face is cut off at the edges of the frame.
- Incorrect photos: accidentally uploading unrelated or unintended images.
- Upside-down or severely rotated photos: images uploaded in the wrong orientation.
- Very low resolution photos: images too small or blurry for the AI to process effectively.
- Flash glare or reflections: photos taken with flash directly on printed album pages.
Photo Quality Advisory Tool
MakeTribute provides an automated Photo Quality Advisory Tool that analyses each uploaded image and assigns one of three status indicators:
- Green — Approved: the image meets quality standards and is expected to produce a good result.
- Yellow — Caution (user approval required): the image has one or more characteristics that may affect the AI animation result, such as a subject facing away from the camera, a blurred or partially obscured face, a profile view, or faces that are small or distant. The tool permits yellow-flagged images to proceed because, in the majority of cases, the AI is capable of producing an acceptable result. However, a satisfactory outcome cannot be guaranteed.
- Red — Not recommended: the image is assessed as unsuitable for AI animation and will not be included in the final video.
When a yellow-flagged image is presented to you, the tool displays the specific concern and requests your explicit confirmation to proceed. By confirming a yellow-flagged image, you acknowledge the stated concern, accept that the result for that image may be unsatisfactory, and waive any right to a refund or remedy on the basis of that image's output. MakeTribute shall not be liable for any dissatisfactory result arising from a photo that you chose to include after receiving a yellow-flag advisory.
The Photo Quality Advisory Tool is provided as a convenience to assist your decision-making. It does not constitute a warranty or guarantee of video quality for any image, flagged or otherwise. MakeTribute makes no representation that the tool will identify every image that may produce a poor result, and its absence of a flag does not guarantee a satisfactory animation.
We strongly recommend using our built-in photo quality checker and reviewing all photos carefully in the correct order before proceeding to payment.
By completing your purchase, you confirm that you have reviewed all uploaded photos and accept responsibility for their suitability.
7. AI Animation & Video Quality
MakeTribute uses advanced AI technology to animate your photos and create a cinematic video experience. While we strive for the best possible result on every photo, the nature of AI-generated animation means that results may vary between photos.
Some photos will be fully animated, with subjects displaying natural movement such as breathing, blinking, subtle head turns, and lifelike motion. Some photos, particularly static posed portraits where subjects are standing still and looking directly at the camera, may receive a cinematic treatment instead of full animation. In these cases, our AI applies a Ken Burns effect — a slow, elegant pan or zoom across the photo — which maintains a professional, cinematic feel while ensuring every photo contributes meaningfully to your video. This is a widely used cinematic technique employed intentionally by professional documentary filmmakers.
The following factors affect animation quality:
- Subject activity: Photos where subjects are actively doing something (playing an instrument, laughing, embracing) animate more dynamically than static posed portraits.
- Photo condition: Clear, undamaged photos with visible faces animate better than blurry or heavily damaged images.
- Orientation: Landscape (horizontal) photos generally animate more naturally than portrait (vertical) photos.
MakeTribute does not guarantee full animation of every photo in your order. By completing your purchase, you acknowledge that some photos may receive cinematic treatment rather than full animation, and that this does not constitute grounds for a refund.
8. AI Photo Restore & Colorize Tool
MakeTribute offers a standalone AI Photo Restore & Colorize tool (at maketribute.com/restore) that restores damaged photos and colorizes B&W or sepia photographs independently from the tribute video service.
By using the Photo Restore tool, you acknowledge and accept:
- User responsibility: You are solely responsible for uploading photos of reasonable quality. The AI requires visible facial detail to produce meaningful results.
- AI-generated facial features: For photos where people are very small, very distant, or faces are severely damaged beyond recognition, the AI may generate entirely new facial features that do not resemble the original person. This is an inherent limitation of AI upscaling technology.
- Not forensic reconstruction: AI restoration creates a plausible enhanced version, not a factual reconstruction. Results should not be relied upon as accurate representations of how people actually appeared.
- Colorization estimates: AI colorization produces plausible color estimates — it cannot recover the actual original colors of clothing, skin tones, or objects.
- Severely degraded photos: Extremely blurry, heavily damaged, or photos where faces are completely obscured may not produce usable results and may contain visible AI artifacts or inaccurate reconstructions.
- Variable results: Quality varies by photo condition, resolution, and subject matter. Unsatisfactory results are not grounds for a refund of paid credits.
- Credits: First 3 restorations per email are free. Additional restorations require purchased credits, which are non-refundable once used.
- Data handling: Same privacy commitments as the main service apply. Photos are deleted within 72 hours.
9. Emotional Content Warning
MakeTribute videos are deeply emotional and may trigger strong emotional responses, particularly when featuring loved ones or deceased individuals. We strongly recommend preparing viewers in advance. Individuals with heart conditions, high blood pressure, or emotional vulnerability should be accompanied by another person when viewing for the first time. MakeTribute is not responsible for emotional distress resulting from viewing the video.
10. Your Content & Copyright
- You confirm that you own or have the legal right to use all photos you upload.
- You confirm that uploading and animating these photos does not violate any third-party rights.
- You grant MakeTribute a temporary, limited license to process your photos solely for the purpose of creating your video. This license expires immediately upon video delivery.
- The final video belongs to you for personal use only. Commercial use, resale, or public broadcast requires prior written consent.
- MakeTribute does not claim ownership of your photos or your final video.
11. Prohibited Content
You may not upload photos that contain:
- Illegal, harmful, abusive, or offensive content
- Content that violates the privacy, dignity, or rights of any person
- Intimate or sexual imagery without explicit consent of all persons depicted
- Content that violates applicable laws in your jurisdiction
We reserve the right to cancel orders containing prohibited content without refund.
12. Third-Party AI Processing
Our service relies on third-party AI platforms to generate video content. Photos are transmitted to these platforms solely for processing purposes and are subject to their respective privacy policies. We are not liable for service interruptions, quality variations, or delays caused by third-party platform outages or changes.
- fal.ai — AI video generation (Kling), AI portrait expansion (bria), AI upscaling (AuraSR), and AI colorization (DDColor)
- Anthropic (Claude Haiku) — AI photo quality analysis, scene detection, and video quality review. Individual photos are sent to Anthropic's API for automated classification. No human reviews your photos at Anthropic.
13. Force Majeure
MakeTribute is not liable for delays or failures resulting from circumstances beyond our reasonable control, including third-party server outages, AI platform unavailability, or internet infrastructure failures. In such cases, we will make reasonable efforts to complete and deliver your order.
14. Age Requirement
You must be at least 18 years old to use this Service and make a purchase.
15. Limitation of Liability
MakeTribute's total liability for any claim arising from use of the Service shall not exceed the amount paid for the specific order in question. We are not liable for indirect, incidental, consequential, or punitive damages.
16. Governing Law
These Terms are governed by the laws of the State of Israel. Any disputes shall be subject to the exclusive jurisdiction of the courts of Israel.
17. Changes to Terms
We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
